These Terms of Service ("Terms") govern your access to and use of the Amarsia Inc. ("Amarsia," "we," "our") Service. By using the Service, you agree to these Terms.

## 1. Service Description

Amarsia provides an AI inference and API builder platform delivered via subscription. The Service includes free and paid tiers.

## 2. Accounts

- You must provide accurate information and keep your account secure.
- You are responsible for activity under your account.
- We may suspend accounts for violations of these Terms.

## 3. Subscriptions & Payments

- The Service is billed on a subscription basis via Stripe.
- Free tier is available; paid plans require valid payment details.
- No refunds are provided once a payment has been processed.

## 4. Acceptable Use

You agree not to use the Service for:

- Illegal, harmful, fraudulent, or abusive activities.
- Reselling, sublicensing, or white-labeling.
- Competing AI services using Amarsia's infrastructure.

## 5. User Data & Ownership

- You retain ownership of your data, documents, and AI interaction logs.
- Amarsia only processes and stores your data for the purpose of delivering the Service.
- Data migration services are available at an additional cost.

## 6. Intellectual Property

- The Service, software, and platform are the property of Amarsia.
- These Terms grant you a limited, non-exclusive, non-transferable license to use the Service.

## 7. Disclaimer & Limitation of Liability

- The Service is provided "as is" and without warranties of any kind.
- Amarsia shall not be liable for indirect, incidental, or consequential damages.
- Our liability shall not exceed the fees paid in the 12 months prior to the claim.

## 8. Termination

- You may cancel your subscription at any time.
- We may suspend or terminate accounts at our discretion for violations.
- Account data is not deleted automatically unless requested.

## 9. Governing Law & Dispute Resolution

- These Terms are governed by the laws of the State of Delaware, USA.
- Any disputes will be resolved exclusively in Delaware courts or via binding arbitration.

## 10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service indicates acceptance of the revised Terms.
